A 50% retainer is required to confirm any scheduled mediation session. Payment in full is required 48 hours before the Mediation Session commences. Any fees for services exceeding the amount of the retainer and for expenses are payable upon billing.
Attorneys will be held jointly and severally liable for all mediation fees and will be billed accordingly for any expenses exceeding the retainer.
The retainer less a $250 scheduling fee will be refunded if the mediator is notified in writing of a cancellation at least 10 business days before the scheduled session. Refunds will not be given for cancellations within 10 business days of the scheduled session.
Both parties and their representatives shall sign a Confidentiality Agreement prior to the Mediation Session agreeing to be bound by applicable state and federal law concerning the confidentiality of the mediation process.
Unless agreed to in advance, a representative of each party with the authority to resolve the dispute shall be present or available by telephone at each session. All parties, and their representatives, are expected to be prepared to discuss information relevant to the conflict.
